1) IDENTIFICATION DATA: In compliance with the duty to provide information, as laid down in article 10 of Act 34/2002, dated 11th July, on Services for the Information Society and Electronic Commerce, the following data is hereby furnished: the company owning areco.org.es (hereinafter, the Site) is ASOCIACIÓN DE OPERADORES LOGÍSTICOS DE ELEMENTOS REUTILIZABLES ECOSOSTENIBLES (ARECO), whose address is Avda. País Valenciano, 55, 3, 6 – 46900 Torrent (Valencia), with tax code (C.I.F): G98266729. The user may get in touch with the association by letters sent by ordinary post to the address of the association’s headquarters or at the following electronic mail address: comunicacion@areco.org.es.

2) USERS: Access and/or use of ARECO portals entails the status of USER, consequently accepting the General Conditions for use given herein as from any such access and/or use.

3) USE OF THE PORTAL: the ARECO SITE gives access to a large number of information items, services, programs or data (hereinafter known as "the contents") on the Internet belonging to ARECO or its ASSOCIATES, to which the USER may gain access. The USER assumes responsibility for use of the Site. This responsibility extends to any registration which might be necessary to access certain services or contents. In any such registration the USER shall be responsible for giving true and lawful information. As a consequence of such registration, the USER may be provided with a password for which he or she will be responsible, undertaking to make diligent and confidential use of this. The USER undertakes to make proper use of any contents and services (such as for example, discussion forums or news groups) that ARECO offers or could offer over its Site and for announcement purposes, without this implying any limitation, not to use these to (i) practise any acts that are unlawful, illegal or in breach of good faith and public order; (ii) disseminate contents or propaganda with a racist, xenophobic or pornographic-illegal nature, justifying terrorism or infringing human rights; (iii) cause any damage to the physical and logical systems of ARECO, of its ASSOCIATES, suppliers, customers or any natural or legal third parties, introduce or disseminate I.T. viruses or any other physical or logical systems which may cause the aforementioned damage on the network; (iv) attempt to access and where applicable use the electronic mail accounts of other users and modify or manipulate their messages. ARECO reserves the right to remove any remarks and contributions which infringe respect for personal dignity, which are against the law, or which in its opinion are not appropriate for publication. In any event, ARECO will not be responsible for any opinions given by users through forums or other participation systems.

4) DATA PROTECTION: ARECO complies with the directives of Organic Act 15/1999 dated 13th December on Personal Data Protection, Royal Decree 1720/2007 dated 21st December enacting the Regulations developing the Organic Act and other legislation in force at any time, and shall make sure proper use and treatment of the user’s personal data is made. To this end, it shall inform the USER of the existence and acceptance of the specific conditions for treatment of their data in each case along with each formula collecting personal data, in the services that the USER may request from ARECO, informing the user of the responsibility for the file created, the address of the person responsible, the possibility of making use of their rights of access, rectification, cancellation or opposition, the purpose of the treatment and any communication of data to third parties, where applicable. ARECO is furthermore making known hereby that it complies with Act 34/2002 dated 11th July, on Services for the Information Society and Electronic Commerce and shall request their consent for processing their electronic mail.

5) INTELLECTUAL AND INDUSTRIAL PROPERTY: ARECO either in its own right or as assignee or licensee pursuant to the consent given by its ASSOCIATES, is the owner of all the intellectual and industrial property rights of its web pages, as well as of the contents of these (for announcement purposes, illustrations, sound, audio, video, software or texts; trademarks or logotypes, combinations of colours, structure and design, selection of materials used, computer programs required for its operation, access and use, etc.), owned by ARECO or by its associates or licensors. All rights reserved. Pursuant to what is laid down in articles 8 and 32.1, paragraph two, of the Intellectual Property Act, any reproduction, distribution and public communication, including the system for making this available, of all or part of the contents of this web page, for commercial purposes, on any support and by any technical means, is forbidden without the consent of ARECO. The USER undertakes to respect the Intellectual and Industrial Property rights held by ARECO. He or she may view the items on the Site and even print these, copy them and store them on the hard disk of their computer or on any other physical support on condition that this is only and exclusively for their personal and private use. The USER shall refrain from removing, altering, eluding or tampering with any protection device or safety system which might be installed on the pages of ARECO.

6) DISCLAIMER OF GUARANTEES AND LIABILITY: ARECO accepts no liability, under any circumstances, for any damages of any kind that might be caused by, merely for announcement purposes, any errors or omissions in the contents, lack of availability of the portal or transmission of viruses or malicious or harmful programs in the contents, in spite of having implemented all the technological measures required for avoiding this.

7) MODIFICATIONS: ARECO reserves the right to make, with no prior notice, any modifications that it may deem fit to its Site. It shall be able to change, remove or add both the contents and services granted through this and the way these are presented or located on its Site.

8) USE OF COOKIES: ARECO may use cookies to personalise and facilitate as far as possible the USER’S navigation on its Site. The cookies are only associated with an anonymous USER and their computer and do not provide any references enabling the USER’s personal data to be learned. The USER may set up his or her browser so as to be notified and reject the installation of cookies sent by ARECO, without this impairing the USER’S possibility of accessing the Contents.

9) LINKS: In the event of the Site having links or hyperlinks to other Internet sites, ARECO will not have any kind of control over said sites and contents. Under no circumstances shall ARECO assume any responsibility for the contents of any link belonging to an outside web site, nor shall it guarantee the technical availability, quality, reliability, accuracy, amplitude, truthfulness, validity and constitutionality of any material or information contained in any of such hyperlinks or other Internet sites. Likewise, including these external connections shall not imply any kind of association, fusion or participation with the concerns connected, except insofar as this involves the associates of ARECO whose relationship with ARECO is established in the by-laws of the association.

10) RIGHT OF EXCLUSION: ARECO reserves the right to refuse or withdraw access to its Site and/or the services offered with no need for any prior notice, at its own request or that of a third party, for any users not complying with these General Usage Conditions.

11) GENERAL: ARECO shall pursue any non-compliance of these conditions as well as any improper use of its Site, bringing any civil and criminal action to which it may be lawfully entitled.

12) MODIFICATION OF THESE CONDITIONS AND DURATION: ARECO may modify the conditions determined herein at any time, being duly published as appearing herein. The current validity of said conditions shall depend on their announcement and these shall be in force until they are modified by others, duly published.

13) APPLICABLE LEGISLATION AND JURISDICTION: The relations between ARECO and the USER shall be governed by current Spanish legislation and any disagreement shall be submitted to the Courts of the city of Valencia.

3. ARECO may modify this Privacy Policy depending on legislative or self-regulation requirements. For this reason users are advised to visit this regularly.

4. ARECO is fully aware of the use and processing that have to be applied to personal data that may be required or that may be obtained from users on its web pages in order to manage the services offered or to send these commercial communications of products or services that may prove of interest to them.

5. ARECO will adopt any technical and organisational measures necessary to guarantee the security of personal data and thus prevent its alteration, loss, unauthorised processing and access, in view of the state of the art, in accordance with what is laid down by the RLOPD. ARECO cannot however guarantee the absolute impregnability of the Internet and thus the infringement of data by fraudulent access to this by third parties.

6. Users shall in any event be liable for the truthfulness of the data supplied and be responsible for informing ARECO of any modification to this, releasing ARECO from any kind of responsibility in this respect.

7. Users are recognised and may practise rights of access, cancellation, rectification and opposition by means of a written notification to the addresses stated in each case or to the address stated in point 1, identifying and specifying their request. Where applicable, they will have to provide a photocopy of their identity card or equivalent document.

8. Pursuant to Act 34/2002, of 11th July, on Services for the Information Society and Electronic Commerce, ARECO shall not under any circumstances send any advertising and communication to users without their prior request or consent. Neither shall it send any messages that have not been requested or given consent for or send chains of electronic messages not requested or previously consented to.

9. ARECO informs its users that in the event of having requested to be sent advertising or merely informative or dissemination messages or alerts, that he or she may deregister from this kind of communication following the instructions stated in each case or informing it in writing through the contract form on the web page.
